Usage of the platform is subject to the application of these terms of use (status: 01/02/2023). Differing terms of use do not apply.

In principle, the platform can be accessed via the internet and accessing individual pages does not require any registration. In order to use the video service, it is necessary to log in to the streaming portal via the ‘Register’ button.

The user needs a valid library id card and a password to do this. It is necessary that the user's library offers the service of myfilmfriend.com.

After successfully logging in, the entire video offering can be used free of charge and without restrictions, while taking into account the age ratings of individual films as appropriate.

The user may not hand over their password to third parties and must keep it protected from access by third parties. If there is reason to suspect that unauthorised persons have gained knowledge of the password, the user must immediately request a new password.

Using the streaming service requires that the user have an internet connection through any provider. A DSL broadband internet connection with a download speed of at least 2,000 Kbit/s and a flat rate tariff are recommended. Bandwidths below this recommendation may lead to waiting times or interruptions. Additional costs, which will be invoiced by the internet provider, may arise for the use of VoD services depending on the provider and tariff of the internet connection used, especially in the case of time or volume tariffs.

It is the user’s responsibility to ensure that their device meets the necessary system requirements for playing the videos and that the internet connection has the necessary speed. The user may not post any illegal, racist, sexist, pornographic, discriminatory, defamatory or insulting content when submitting comments. myfilmfriend, Inc. reserves the right to review and release the content as well as delete it.

Users are responsible for installing anti-virus software and appropriate safeguards against viruses, Trojan horses, worms, malware, time bombs, "bots" or other computer programming routines, methods or engines designed to damage, destroy, interfere with or otherwise exploit the functionality or operation of any computer that may be transmitted to your computer or device through the Platform, related software and/or Content.

The titles made available to the user on the platform are protected by law, in particular by copyright and ancillary copyrights. Upon successful login, the user receives a private right of use, i.e. the non-exclusive, non-sublicensable right to view the acquired titles as a stream via the internet.

Commercial use of the acquired titles is prohibited. The user may not misuse the platform; in particular, they may use the accessed content exclusively for private screenings for non-commercial purposes. They may not publicly present, make publicly accessible, send, edit, reproduce, distribute, market, publicly reproduce, advertise, support such uses or otherwise use the retrieved content in any form outside the contractually agreed purpose. They may only use the retrieved content in compliance with national and international copyright law within the scope of the rights of use granted by these terms and conditions and may not reproduce the content; they may not remove or change copyright and proprietary notices for the content. The user must protect the content from any use by unauthorised persons and from other misuse. They may only present, have presented or otherwise make accessible to children or adolescents such content that is open for the respective age group.

Streamed film files may not be copied by the user. To protect against illegal copies, the streams are therefore protected using appropriate measures. Circumventing these protective measures is not permitted and doing so may lead to prosecution.

The content of the service is primarily available in the country in which the user(s) have created an account and only in geographical regions in which we offer our service and for which we have licensed such films and series. The content is protected from unauthorised use in unlicensed territories by means of geo-blocking. Circumventing geo-blocking by means of VPN, proxy or similar services/measures constitutes a breach of duty within the meaning of section 5 of these terms of use.

myfilmfriend, Inc. shall not be liable for damages resulting from a breach of duty for which the user is responsible and which could have been prevented by adhering to the duties.

The user is personally and directly liable to third parties for the violation of their rights. In the case of justified claims by third parties due to such an infringement, the user is obliged to indemnify myfilmfriend, Inc. unless they can prove that they are not responsible for the breach of duty causing the damage.

The platform is subject to the German Data Protection Act. You can find more detailed explanations on data security in our data protection regulations.

myfilmfriend offers movies, that got different age ratings. In every registration a verification of age of the user through the library ID is happening.

For the purpose of the authentication by the library is an encrypted channel produced that leads directly to the user databank of the library.

After authentication, the library transfers following status information to myfilmfriend:

Borrowing privileges, age classification. Is the verified age underneath the age rating for a movie, the user can’t play the movie.

WARNING: Some content available on the platform may be considered offensive, objectionable, discriminatory, or controversial. Users are responsible for their own use of the platform and the content they view. Parents and legal guardians are responsible for their children's access to content available through the platform.

By using the platform or the platform’s services, myfilmfriend, Inc. does not guarantee the quality of the content available or the services provided. This also applies to the quality of the films, which vary depending on the source material received by myfilmfriend, Inc. from the licensors (e.g. due to poor scanning of an original film reel).

myfilmfriend, Inc may, at any time in its sole discretion, remove content from the platform without notice. myfilmfriend, Inc. reserves the right at any time in its sole discretion to modify, suspend or discontinue the platform or any part of thereof, any content (or any part thereof) at any time without notice. myfilmfriend, Inc. shall not be liable for any modification, suspension, or discontinuation of the platform or any content available through the platform.

myfilmfriend, Inc. shall not be liable for incidental, punitive, special or consequential damages of any kind arising out of the use of the platform or any software, content, information, materials, services or products contained on or otherwise made available to users through the platform.

Certain state laws may not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to users, some or all of the above disclaimers, exclusions or limitations may not apply to these users and these users may have additional rights.

myfilmfriend, Inc. reserves the right to change the terms of use from time to time. These amendments shall enter into force immediately.

These Terms of Use are governed by the United States Federal Arbitration Act, other applicable federal laws and the laws of the State of Georgia.

Should individual parts of these terms of use be or become invalid or void, this shall not affect the validity of the remaining terms of use.
